90-year-old dementia patient sentenced to 1.5 years for fatally assaulting nursing home peer over TV remote

A 90-year-old man with dementia has been sentenced to 1.5 years in prison for causing the death of another resident at a nursing home. The incident, which took place last September, involved the elderly defendant becoming enraged because his fellow resident, an 80-year-old man, refused to hand over the television remote. The court heard that the 90-year-old repeatedly struck the victim in the face and body with his fists. The 80-year-old man suffered a cerebral hemorrhage and died the following day. The Uijeongbu District Court's Criminal Division 1, presided over by Judge Kim Sung-sik, acknowledged the gravity of the offense and the tragic outcome. However, the court took into account the defendant's advanced age and his diminished mental state due to dementia, including impaired cognitive function, judgment, and impulse control. Consequently, the court decided against immediate incarceration, recognizing his 심신미약 (simshinmiyak - state of diminished mental capacity) at the time of the offense. The court stated that while the defendant's culpability is significant and he has not received forgiveness from the victim's family, his condition warrants consideration.
