AI-assisted music now eligible for copyright registration in South Korea

South Korea has updated its copyright policy to allow registration for music created with artificial intelligence, provided human creators played a substantial and leading role in the process. The Korea Music Copyright Association (KOMCA) announced the change on August 3rd, reversing a previous stance that withheld registration for AI-assisted works.

Under the new rules, songs generated entirely by AI from simple text prompts remain ineligible for copyright. Applicants must disclose the AI tools used, detail their incorporation into the creative process, and certify the accuracy of their submissions. KOMCA may request additional materials, such as project files or prompt records, to verify the extent of human authorship.

This policy aims to formally recognize AI-assisted creativity while protecting the rights of human artists. KOMCA stated the revision's purpose is to "formally recognise AI-assisted creative practices while safeguarding the rights of human creators." Works found to be entirely AI-generated or registered with false information could face penalties, including suspended or repayment of royalties and termination of trust agreements. KOMCA also plans contractual penalties of up to three times the amount of improperly received royalties for intentional misconduct.

The move establishes South Korea's first codified standard for registering AI-assisted music, integrating such works into the existing copyright system. This aligns with global efforts to develop standards for AI-generated content, as seen with the International Federation of the Phonographic Industry's recent principles for AI-assisted recordings on official charts. The increasing popularity of AI-created songs on streaming platforms and social media has fueled the debate over AI's role in music production.
