Argentine Father Recovers Children in Brazil After Legal Battle, Awaits Return to Argentina

After more than two years of legal disputes, Argentine father Herman Krause has achieved a significant victory as a Brazilian court ordered the restitution of his two children to Argentina. The children had been taken illegally by his ex-wife in October 2024. They are now under Krause's care and have been living with him in São Paulo since then.

However, the children's return to Argentina cannot yet be finalized. The family remains in Brazil, awaiting a decision from a higher tribunal, the Regional Federal Court of the 3rd Region (TRF-3), which has not provided a defined timeline for its ruling. This situation represents a substantial advancement for Krause, who had traveled to Brazil multiple times since mid-2025 to report his ex-wife's illegal removal of his children from the country.

On July 15, while visiting his children with a social worker, Krause was notified of the judicial decision. The ruling mandated the international restitution of the children to Argentina, their country of birth and previous residence, and stipulated that they remain provisionally with their father while the legal process continues. Krause recounted the moment, stating, "They handed the children over to me immediately."

Despite the favorable ruling, the immediate return is conditional. The judge has linked the execution of the order to the intervention of the TRF-3, which must rule on an appeal filed against the decision. Krause's lawyer, Marcelo Peña, confirmed that the opposing party has appealed the sentence. Until the higher court intervenes, the children must stay in Brazil with their father, and Krause cannot leave the country with them.

This procedure follows a recommendation from Brazil's Council of Federal Justice for international restitution cases. Krause's lawyer expressed confidence in the eventual outcome, noting that all evidence favors Herman, but acknowledged concern over the delay. "We are calm, surely they will confirm this custody because all the evidence has come out in Herman's favor. What is uncertain is the timeframe, because he is held there," Peña added. While waiting, Krause has begun building a new life with his children in Brazil.
