Belgian man gets community service for resisting arrest, filming police

A 50-year-old man from Lommel has been sentenced to 200 hours of community service for resisting arrest and filming police officers during his apprehension. Failure to complete the service within the allotted time could result in an 18-month prison sentence.

The incident occurred in late 2024 when officers from the Noord-Limburg police zone were conducting a house search in Lommel. The man, a neighbor, interfered with the operation, scratching a police vehicle and breaking a car window. He then stood in the street with his hands in his pockets, prompting officers to arrest him. During the arrest, police used pepper spray and pain compliance techniques to handcuff him.

The man recorded his arrest via his doorbell camera and uploaded the footage online, clearly showing the officers. The video was subsequently distributed by an far-right publication. The court determined that the man should have anticipated that the images could be shared widely and gain a life of their own.

His lawyer, Erik Schellingen, who represented the officers and the police zone, likened the scene to a Hollywood film. He argued that the police acted calmly despite the man's provocative stance, contrasting the situation with potentially more forceful responses in other countries. The public prosecutor emphasized that police should not be subjected to ridicule and that their actions were justified given the man's obstructive behavior.

The judge described the man's conduct as "particularly reprehensible and deplorable," noting his failure to consider the negative consequences for the officers involved. The man had a prior conviction for armed resistance and assaulting an officer, for which he had received a probationary sentence. In addition to the community service, he must pay a total of €8,246 in damages to the three officers and the police zone for physical, moral, and material harm.
