Bucharest Court Halts Draft Salary Law at Union's Request

The Bucharest Court of Appeal has suspended the effects of the draft salary law, responding to a request from the Sanitas Federation. The court admitted the presidential ordinance, effectively halting the legislative progress of the act published on July 17.

Judges at the Court of Appeal's administrative and fiscal contentious section accepted Sanitas's request against the Ministry of Family. Decision no. 1282/2026 suspends the procedure for the draft law concerning salaries for personnel paid from public funds. This suspension will remain in effect until the case is definitively resolved.

The Sanitas Federation welcomed the court's decision, asserting it upholds their right to participate in social dialogue and contribute relevant solutions to healthcare system issues. The union emphasized that the draft law can no longer proceed through parliamentary procedures because the court identified a clear appearance of illegality, stemming from a lack of genuine consultation with unions.

"Sanitas writes history. At the request of the Sanitas Federation, the Court of Appeal suspended the effects of the draft law published on 17.07.2026. Thus, justice has been done and we have been given the chance to voice our opinion, to be consulted and to offer pertinent solutions to the problems of the health system. We now have the right to participate in social dialogue," the federation stated on Facebook. They added that the project can no longer produce any effects and cannot follow parliamentary procedures because the court found a manifest appearance of illegality.

The decision can be appealed within five days of communication. The suspension until the final resolution of the case blocks the legislative path of the project, obligating the government to resume official negotiations.
