California clarifies AB 60 license eligibility and REAL ID requirements

California's Department of Motor Vehicles (DMV) has provided updated details on the application process for AB 60 driver's licenses, a permit available to individuals who cannot provide proof of legal presence in the United States. The guidelines clarify the required documents, exams, and appointments, while also explaining when a secondary review might be necessary and the conditions under which a REAL ID can be requested.

The AB 60 license is specifically designed for residents who lack legal immigration status. To qualify, applicants must meet state driving requirements and provide verifiable proof of their identity and residency within California. However, the DMV explicitly states that individuals holding an AB 60 license are not eligible to obtain a REAL ID, which has stricter federal and state requirements, including proof of legal presence.

To apply for an AB 60 license, individuals must submit original documents proving their identity and California residency. Accepted identity documents include California driver's licenses or ID cards issued since October 2000, specific voter credentials from Mexico, and certain foreign passports accompanied by a verifiable Social Security number. Residency can be proven through rental agreements, property deeds, mortgage statements, or utility bills, including cell phone statements.

The application process can be initiated online through a MyDMV account, but it must be finalized in person at a DMV office. Applicants are required to bring all original documents uploaded during the online phase to their scheduled appointment. The DMV also outlined the steps for resetting a DMV password, indicating a focus on streamlining access to their services.
