Charlie Kirk Murder Suspect Pleads Not Guilty and Faces Possible Death Penalty

Tyler Robinson will face trial for the killing of Charlie Kirk after a Utah judge rejected an attempt to remove the most serious charge from the case. The 23-year-old suspect pleaded not guilty to all seven counts and could face the death penalty.

Judge Tony Graf ruled that prosecutors may pursue an aggravated-murder charge. In Utah, it is the only charge in the case that allows a death sentence. The designation can apply when a murder includes an additional element, such as putting other people’s lives at risk.

Robinson’s lawyers argued that the charge should be dismissed because only one bullet had been fired at one target. Graf disagreed. He said Robinson allegedly used a powerful rifle in the direction of a crowd numbering in the thousands, creating a deadly danger for people nearby. The judge also found that the evidence currently sufficiently established Robinson as the shooter.

The ruling does not determine Robinson’s guilt or set a sentence. It moves the case toward trial, and a further preliminary hearing is scheduled for October 23, 2026. Kirk’s family welcomed the decision.

Kirk was shot in the neck on September 10, 2025, while speaking to students at Utah Valley University. He died almost immediately. Prosecutors allege that Robinson fired from the roof of a neighboring building. They say Robinson’s DNA was found on the weapon and on a towel wrapped around the rifle, while messages he allegedly sent to his partner after the shooting contained a confession.

Released chat messages and court documents also point to a possible motive. Prosecutors say Robinson opposed Kirk’s far-right views and believed Kirk spread hatred. Unfired cartridge casings found at the scene reportedly carried messages including “Hey fascist, catch!” and “bella ciao, bella ciao, bella ciao,” a reference to the Italian resistance song.
