Civil rights association demands end to initiative preventing citizens from returning to Israel

The Association for Civil Rights in Israel has lodged an urgent appeal demanding that initiatives potentially barring Israeli citizens abroad from returning to vote be halted immediately. The appeal targets key election committee officials, the Transportation Minister, and the Attorney-General.

Reports suggest senior Transportation Ministry officials are considering measures to prevent Israelis living abroad from arriving on charter flights for the upcoming Knesset election. The association contends that such actions, if driven by political considerations, would unlawfully deny thousands of citizens their fundamental right to enter the country and cast their vote.

Placing obstacles or difficulties in the way of voters seeking to reach the country, particularly because of their presumed political leanings, is unconstitutional and constitutes a clear manifestation of the abuse of government authority by a government that knows no limits.

Emphasizing that the right to vote is a cornerstone of democracy and a fundamental constitutional right, the association stated that obstructing voters' access to the country is unconstitutional. They argue that the state has an obligation to facilitate, not impede, citizens' ability to vote.

Attorney Elsa Bonia, who penned the appeal, called such measures an "unconstitutional and clear manifestation of the abuse of government authority." She stressed that even logistical constraints cannot justify infringing on the right to vote, asserting that the state must make every effort to ensure citizens can participate in elections without obstruction.

It must be emphasized that even without the reports that extraneous considerations are behind the measure, bureaucratic or logistical considerations cannot justify infringing on Israeli voters’ right to reach Israel and vote. On the contrary, the state must make every possible effort to ensure the entry into the country of all citizens who wish to vote in it.
