Company CEO receives suspended sentence in fatal accident case

The CEO of a construction materials company has received a suspended prison sentence for his role in a fatal workplace accident. The court found that inadequate safety measures contributed to the death of a 41-year-old worker in August 2024.

The company's chief, identified as Mr. A, was sentenced to 10 months in prison, suspended for two years, and his company was fined 70 million won. The loader operator, Mr. B, received a 8-month prison sentence, also suspended for two years. The accident occurred when the loader struck a worker, Mr. C, who was cycling, leading to a fatal 'run-over' incident.

The defendants' failure to implement safety measures and their negligence were severe, resulting in the victim's death, for which their culpability is very heavy.

An investigation revealed a lack of essential safety protocols at the site, including missing aisle markings and the absence of a safety supervisor. Furthermore, no work plan was developed, and the loader's rear-view camera was malfunctioning. The court acknowledged the severity of the defendants' negligence but considered the company's subsequent efforts to improve safety facilities and training, along with a settlement reached with the victim's bereaved family, in its sentencing.

In a separate but related case, the company's CEO, Mr. A, was charged with violating the Serious Accidents Punishment Act. The court determined that his failure to implement proper safety measures directly contributed to the fatality. The company was also fined 70 million won.
