Conflicting Court Judgments Undermine Nigeria's Judiciary

Nigeria's judiciary is facing increasing scrutiny over a disturbing trend of conflicting court judgments, which threatens public trust in the administration of justice. The National Judicial Council (NJC) and the Chief Justice of Nigeria have repeatedly warned against this issue, yet inconsistent pronouncements from courts of coordinate jurisdiction continue to emerge.

A recent Federal High Court in Abuja ordered the deregistration of five political parties, including the African Democratic Congress (ADC) and Accord Party (AP). This judgment is particularly troubling as it disregarded a subsisting order from the Court of Appeal directing the trial judge to halt proceedings on the matter pending the determination of an appeal. Such actions raise questions about judicial discipline and adherence to legal procedures.

Further exacerbating the problem is the tendency of some judges to issue rulings on issues not raised by the parties involved in a case. Courts are meant to adjudicate on matters presented before them, not to venture into extraneous territories. This practice not only invites controversy but also erodes public confidence in the judicial process.

Adding to the confusion, litigants and stakeholders often selectively interpret court judgments to suit their own interests. Instead of adhering to the full spirit of a ruling, they highlight only the aspects that favor their positions, while ignoring other parts of the same decision. This selective application of judicial pronouncements contributes significantly to the ongoing confusion surrounding high-profile legal disputes, including recent interpretations of a Supreme Court judgment concerning the Peoples Democratic Party (PDP).
