Court extends Homeplus rehabilitation proceedings to Sept. 4; stakeholders' meeting expected late next month

A South Korean court has reversed its decision to terminate the rehabilitation proceedings for the retail giant Homeplus, enabling the company to continue its restructuring efforts. The Seoul Rehabilitation Court's Rehabilitation Division 4 canceled the termination order after Homeplus secured a commitment for a 200 billion won (approximately $145 million) emergency operating fund from its largest creditor, Meritz Financial Group.

The court's initial decision to terminate the proceedings was based on Homeplus's inability to secure the necessary operating funds, which raised doubts about its ability to execute a rehabilitation plan. However, with the new funding commitment, the court found sufficient grounds to overturn its previous ruling. The deadline for approving the rehabilitation plan has been extended to September 4, the legal maximum.

Homeplus had recently announced temporary closures for 67 of its stores and its online mall, starting August 13, due to operational funding issues. The court's decision is expected to allow the company to normalize its operations soon. The company had previously submitted a revised restructuring plan focused on improving profitability, which includes measures like closing underperforming stores, selling business units, and pursuing mergers and acquisitions.

A meeting of stakeholders to review and vote on the rehabilitation plan is anticipated between the end of August and early September. If the court approves the plan following this meeting, Homeplus will begin making payments according to the finalized terms. The company has the flexibility to submit further revisions to its rehabilitation plan before court approval, with no limit on the number of submissions.

The previous termination decision was based on the lack of operating funds, making it impossible to proceed. Since operating funds have been secured, there are legitimate grounds for an immediate appeal.
