Expired goods will not return to the market as Cabinet prepares new rules

Kyrgyzstan’s Cabinet has submitted a draft resolution for public discussion that would create a single procedure for disposing of counterfeit, confiscated and expired products.

The proposed rules would set common requirements for preparing goods for disposal, transferring them for recycling, neutralizing them and destroying them. They would also define how state bodies, organizations and other authorized parties should work together.

The main aim is to prevent goods that can no longer legally circulate from returning to the market. The government also says the system would reduce the products’ potential harm to the environment and public health.

The draft focuses mainly on the environmental handling of these goods and the waste created during sorting, recycling, neutralization and destruction. Some categories would remain subject to special rules, including food and raw materials deemed unfit for consumption or sale, as well as medicines and medical devices.

Separate regulations already govern the registration, storage, destruction and sale of confiscated property and evidence in criminal and administrative cases. The Cabinet expects the unified procedure to provide a clearer mechanism for products removed from legal circulation because they are expired, counterfeit or confiscated. According to the explanatory note, adopting the document would not require additional state budget spending.
