Fetal personhood laws challenge women's rights in America

The constitutional rights of women in the United States face a significant challenge from a radical movement known as "fetal personhood." This concept aims to grant fertilized eggs, embryos, or fetuses full legal status as human beings, effectively turning pregnant individuals into incubators without autonomy.

The "fetal personhood" movement is not a recent development but the result of decades of strategic planning, funding, and networking by Christian fundamentalist organizations, conservative lobbies, and the right wing of the Republican Party. After the Supreme Court legalized abortion in 1973, anti-abortion groups realized they could not easily amend the Constitution. Their long-term strategy became convincing the legal system that a fetus is a "person" from the moment of conception, which would automatically make abortion illegal.

Key organizations like Americans United for Life, which drafts model legislation, and groups such as Personhood USA and the Federalist Society have been instrumental in advancing this agenda. The Supreme Court's 2022 decision in Dobbs v. Jackson Women's Health Organization, which overturned Roe v. Wade, has opened the floodgates for the implementation of these laws nationwide.

What began as a rhetorical and political tool against abortion has transformed into a dangerous legal mechanism. It fundamentally alters the constitutional standing of pregnant individuals, reducing them to second-class citizens with severely limited rights over their own bodies, health, and decision-making. This shift has not gone unnoticed, recently being highlighted by satirist John Oliver on his show "Last Week Tonight."
