Former Lampung Governor Arinal Djunaidi's Pre-trial Review Rejected, Suspect Status Upheld

A pre-trial review filed by former Lampung Governor Arinal Djunaidi has been rejected by the Corruption Eradication Court at the Tanjungkarang District Court, effectively upholding his status as a suspect in a corruption case. The sole judge, Agus Windana, dismissed all of Djunaidi's requests, confirming that his legal standing as a suspect in the alleged mismanagement of the Participating Interest (PI) 10 Percent fund of PT Lampung Energi Berjaya (LEB) remains valid.

During the ruling on Tuesday, Judge Agus Windana stated that the applicant's pre-trial motion was denied. He clarified that a Constitutional Court ruling, cited as a basis for the applicant's argument, does not override previous Constitutional Court decisions. Furthermore, the judge asserted that the authority of the Supreme Audit Agency (BPK) does not negate the powers of other law enforcement agencies in the legal process. The judge also found that the investigators from the Lampung High Prosecutor's Office had followed all legal procedures in naming Djunaidi as a suspect and detaining him.

Henry Yosodiningrat, Djunaidi's legal counsel, stated that his team respects the court's decision. He acknowledged that both the applicant and the respondent had presented their respective legal arguments during the trial. Yosodiningrat added that his team would not further comment on the ruling, as it falls under the judge's purview to assess and decide cases.

Meanwhile, Rudy Vernando, a prosecutor from the Lampung High Prosecutor's Office, indicated that the judge's considerations affirmed that the investigation process adhered to legal provisions, referencing Supreme Court Regulation No. 4 of 2016 and a Supreme Court Circular. He noted that various pieces of evidence, including witness testimonies, expert opinions, financial transactions, and audit reports from the Development Finance Audit Agency (BPKP), were presented during the trial. The prosecutor's office is currently finalizing the investigation before submitting the case files to the public prosecutor. The detention period for Djunaidi will be adjusted based on the investigation's needs and can be extended as per regulations.
