Former Party Spokesperson Fined for Defaming Ex-Spouse, Appeals Ruling

Kang Mi-jeong, the former spokesperson for South Korea's Cho Kuk Innovation Party, has been fined 2 million won in a first-instance trial for defaming her ex-husband during their divorce proceedings. The court found her guilty of damaging the reputation of her former spouse, identified as Mr. Cho, through statements made in media interviews and on YouTube.

Kang had accused Mr. Cho of drug offenses in February 2023, reporting him to the police. Subsequently, in November of the same year, she allegedly made statements to the press and on YouTube claiming Mr. Cho had used narcotics, thereby infringing upon his honor ten times. Mr. Cho, who was cleared of the drug charges, subsequently filed a defamation lawsuit against Kang.

During the trial, Kang argued that her statements were related to public matters and constituted justifiable acts. However, the court rejected this defense, stating that such actions could not be considered justifiable or self-defense. The court upheld the initial summary order, imposing the 2 million won fine.

Following the first-instance ruling, Kang Mi-jeong has lodged an appeal, indicating her intention to contest the verdict. The case has also drawn attention due to allegations that Mr. Cho's brother-in-law, Daejeon High Prosecutor's Office prosecutor Lee Jung-seop, may have exerted undue influence during the investigation into Mr. Cho's alleged drug use.

This legal battle unfolds against the backdrop of political sensitivities surrounding the Cho Kuk Innovation Party. Kang Mi-jeong's defamation conviction and subsequent appeal highlight the complex personal and legal entanglements that can arise, particularly when public figures are involved and allegations of serious misconduct are made.
