Gwanak District Pizza Shop Murderer Sentenced to Life Imprisonment in Second Trial

Kim Dong-won has been sentenced to life imprisonment in the appellate court for the murders of three people, including an interior designer and his daughter, at a pizza shop. This decision upholds the initial ruling from the first trial.

Murder is a grave crime that cannot be tolerated under any circumstances, and stress from interior design issues cannot justify or serve as grounds for mitigation.

The Seoul High Court's Criminal Division 3 stated that murder is a grave crime that cannot be tolerated under any circumstances. The court rejected Kim's claim that stress stemming from interior design disputes could justify or mitigate his actions. Furthermore, the court did not consider the 45 million won Kim had additionally deposited for the victims' families as a mitigating factor, as the beneficiaries had no intention of accepting the funds.

However, the court acknowledged that Kim had no prior criminal record, admitted to the crime, and showed signs of remorse. These factors led the judges to conclude that the circumstances did not warrant a death sentence. The appellate court found the original life sentence to be appropriate, neither excessively lenient nor severe, and dismissed appeals from both the prosecution and the defense regarding the sentencing.

Considering that Kim has no prior criminal record, admits to the crime, and shows remorse, it is difficult to conclude that the circumstances clearly warrant a death sentence.

Kim was convicted of fatally stabbing three individuals at a pizza shop he operated in Seoul's Gwanak District in September of the previous year. The victims included the interior designer and two other individuals.
