ICC Member States Vote to Remove Chief Prosecutor Karim Khan Over Misconduct Allegations

The International Criminal Court (ICC) faces a significant leadership crisis after its member states overwhelmingly voted to remove Chief Prosecutor Karim Khan. The decision, made by 125 member states, cited "gross misconduct and dereliction of duty" as the grounds for Khan's dismissal.

According to Païvi Kaukoranta, representing the ICC's governing body, the misconduct relates to Khan's actions towards a Malaysian female lawyer employed under his supervision. While Khan has denied allegations of sexual misconduct and announced his intention to appeal, his position appears untenable. Kenneth Roth, former executive director of Human Rights Watch, commented that Khan's removal was "very good" and that he "behaved deplorably," failing to meet the highest moral standards expected of a prosecutor.

Khan's removal comes four years before the end of his term, forcing the ICC to seek a new chief prosecutor. This search occurs at a time when the court is grappling with internal and external challenges, including a highly politicized environment. Many nations, including non-member states, exert pressure on the court and its staff.

Adding to the turmoil are the ongoing arrest warrants issued by Khan in 2024 against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant for alleged war crimes and crimes against humanity during the Gaza conflict. These warrants have drawn both strong support from critics of Israel and fierce opposition, particularly from Israel and the United States, which has threatened sanctions against the ICC and Khan.
