ICC Suspends Chief Prosecutor Karim Khan, Decision on Future Moves to Member States

The International Criminal Court (ICC) has immediately suspended its chief prosecutor, Karim Khan, placing the responsibility for determining his future with the court's member states. This move comes amid allegations of inappropriate sexual conduct leveled against the British official since April 2024.

The decision was made by the Bureau of the Assembly of States Parties, the ICC's administrative oversight body, during a meeting in The Hague. The case will now be considered by the tribunal's 125 member nations, who will vote on Khan's continued tenure. The Bureau emphasized that the suspension is temporary and does not indicate a final outcome of the proceedings.

The ICC's action follows a review of various reports, evidence, and legal opinions. These include findings from the UN Office of Internal Oversight Services (OIOS) and conclusions from an independent panel of judicial experts. While the documentation remains confidential, the case has ignited significant internal controversy for the court.

Accusations surfaced in April 2024 when a subordinate reported alleged non-consensual sexual conduct. Initial internal reviews were followed by a broader investigation led by the UN. Although the UN report has not been released, reports suggest it found elements supporting the allegations. Conversely, the independent panel concluded that the available evidence did not substantiate misconduct according to required proof standards, creating divergent interpretations among member states.

This division among member states, with some arguing insufficient grounds for proceedings and others deeming the allegations serious enough to continue, has persisted for months. The controversy coincides with a period of high international visibility for the ICC Prosecutor's Office, with Khan having recently sought arrest warrants against Israeli officials.
