Indonesian Constitutional Court Declares Internet Data Expiry Case Unclear

The Indonesian Constitutional Court, in its wisdom, has dismissed a case challenging the policy on expiring internet data quotas. The court, through Justice Saldi Isra, found the petition to be 'obscuur' – unclear and lacking substance. This decision reflects the MK's commitment to upholding procedural rigor and ensuring that legal challenges are well-founded.

The applicant, Rachmad Rofik, failed to provide a clear legal basis for the court's jurisdiction and did not sufficiently articulate how their constitutional rights were infringed upon by the internet data policy. The court emphasized that simply invoking the MK's role as the 'Guardian of the Constitution' and 'Protector of Citizen's Constitutional Rights' is insufficient without detailed legal arguments and a clear connection to demonstrable harm.

While this particular case may be dismissed, it is important to note that the issue of expiring internet data is a significant concern for many Indonesians, particularly online motorcycle taxi drivers and online food vendors, as evidenced by the 31 similar cases pending.
