Labor Minister to clarify "Yellow Envelope Law" amid presidential concerns

South Korean Labor Minister Kim Young-hoon pledged to enhance on-site explanations of the controversial "Yellow Envelope Law" and review its enforcement decrees. This commitment follows President Lee Jae-myung's directive to clarify the law's application and address potential confusion among labor and management.

President Lee had previously criticized the Samsung Electronics union's attempt to include the "Honam Semiconductor Mega Project" as a subject for labor negotiations. The union also demanded a share of the company's operating profits. Lee questioned whether such strategic business decisions, including potential factory relocations or investments, should fall under the purview of labor disputes, suggesting that the scope of such demands seemed to be expanding indefinitely.

In response, Minister Kim stated that the ministry would diligently examine how the Yellow Envelope Law is being implemented on the ground since its enactment. The minister's remarks suggest that the government, like the ministry, views the union's push to negotiate factory relocation as a misinterpretation of the law's purpose.

The Yellow Envelope Law, officially the revised Act on the Regulation and Adjustment of Labor Relations, has been a focal point of debate. The Ministry of Employment and Labor had previously stated that decisions regarding corporate investments, such as factory expansions or relocations, are generally considered management prerogatives and do not fall under the scope of collective bargaining or labor disputes as defined by the law. Minister Kim's latest comments align with this stance, indicating that the government intends to reinforce this interpretation.
