'Life-saving' Australian-first veterans court to launch in SA

South Australia is set to launch a pioneering initiative aimed at supporting its veteran community. The South Australian Veterans Court (SAVC) Pilot Program, described by advocates as a "life-saving" measure, will commence next week. This specialized therapeutic court is designed to connect eligible veterans with crucial rehabilitation and support services before they are sentenced for offenses.

It will also enable the court to approach sentencing decisions informed by a participant's rehabilitation progress and the circumstances associated with their military service.

The establishment of the SAVC is a direct response to a key recommendation from the Royal Commission into Defence and Veteran Suicide. The pilot program is slated to run for 12 months, with court sessions held monthly at the Elizabeth Magistrates Court. A court spokesperson highlighted that the program will acknowledge the unique challenges faced by veterans due to their military service and its impact on them and their families. This understanding will inform sentencing decisions, taking into account a participant's progress in rehabilitation and the circumstances of their service.

We're in a really unique position here in South Australia in that we have a population that is both large and small enough to be able to facilitate some really interesting initiatives.

Veterans facing charges in Adelaide's magistrates courts can seek a referral to the Veterans Court, provided they have pleaded guilty to the most serious and majority of charges. The process involves a preliminary assessment to determine veteran status, the link between service and offending, and the willingness to engage in rehabilitation. If deemed suitable, a remand will be granted for participation in treatment and rehabilitation, with regular court reviews to monitor progress. Notably, all state magistrates are eligible to preside over the SAVC, with some having prior service in the Australian Defence Force (ADF).
