Man Acquitted in Housing Application Fraud Case Over Mother's Registration

A South Korean public servant in his 50s has been acquitted of charges of violating housing laws by falsely registering his mother as a dependent to boost his application for a lucrative apartment.

The individual, identified as Mr. Yoon, was accused of registering his mother, who has been a long-term resident of a nursing hospital for 18 years, at his own address in Seoul's Yeongdeungpo district. He then used this false registration to claim additional points for a dependent when applying for the 'Raemian One Pentas' redevelopment apartment in Banpo-dong, Seocho district, in July 2024. This strategy reportedly secured him 74 points, leading to his selection as a resident.

Prosecutors charged Yoon with illegally obtaining preferential points by claiming his mother as a dependent, despite her not living with him. However, Yoon's defense argued two key points during the trial. Firstly, they contended that the housing law's punitive provisions were not applicable to this particular residential complex, as it was constructed under urban redevelopment laws.

Secondly, the defense argued that his mother's registration at the nursing hospital was legally valid under the resident registration law. The court, presided over by Judge Kim Beom-jin, ultimately ruled in favor of Yoon, acquitting him of the charges. The ruling suggests that the specific legal framework for urban redevelopment projects and the definition of a valid residential registration were critical factors in the decision.
