NYC Mayor Considers Arresting Netanyahu Over ICC Warrant

New York City Mayor Eric Adams has stated he is exploring measures to arrest Israeli Prime Minister Benjamin Netanyahu should he visit the city for the UN General Assembly in September. Adams cited an International Criminal Court arrest warrant issued in November 2024 for alleged war crimes in the Palestinian territories as the reason for this potential action.

Adams, who is New York's first Muslim mayor, has been a vocal critic of Israel's policies in Palestine. During his mayoral campaign, he pledged to order the New York Police Department to arrest Netanyahu if he came to the city. In a podcast interview with The New York Times, Adams referred to Netanyahu as a "war criminal" and stated that the Prime Minister should be in The Hague, where the ICC is headquartered.

However, the practicalities of such an arrest are highly questionable. The United States is not a signatory to the ICC, and it remains unclear whether a municipal official like Adams possesses the authority to detain a foreign head of state. Adams indicated that he is discussing the legal authority for such an arrest with the New York City Law Department but stressed that the city would not create its own laws to facilitate it.

Legal analysts suggest that arresting Netanyahu would be extremely difficult. Former US administrations have been critical of the ICC, and current officials have expressed strong opposition to its actions. While Netanyahu might have immunity within the UN headquarters, he could be vulnerable to arrest if he travels within New York City. Some observers have characterized the situation as a "chicken game" between Adams and Netanyahu.

Netanyahu himself has dismissed the threat, stating he is "not concerned." He accused Adams of supporting Hamas and disliking the United States. Israel's UN Ambassador Danny Danon criticized Adams, claiming he is mismanaging New York City and seeking attention by attacking Israel.
