The High Court is scrutinizing the political influence within private educational institutions, issuing a rule that challenges the current regulations. The court demands an explanation from the government regarding the necessity of measures to depoliticize the governing bodies and management committees of these institutions nationwide.

At the heart of the matter is Rule 7 of the Private Educational Institutions Governing Body and Managing Committee Regulations, 2024, which permits individuals with political affiliations to contest elections, be nominated, or be approved as members. The court questioned the legality of this rule, seeking to understand why authorities should not be directed to amend it or create a new one that disqualifies politically affiliated individuals.

Furthermore, the bench inquired about the possibility of introducing provisions to increase the participation of local education enthusiasts, retired teachers, distinguished social workers, freedom fighters, educationists, lawyers, physicians, and other eminent citizens with proven integrity in the management of these institutions. The court also sought judicial guidelines to guarantee transparency, accountability, good governance, and political neutrality in their administration.

A public interest litigation was filed last month by Md Rubel Miah of Jamalpur, represented by Supreme Court lawyer Md Nadir Khan. The petition argues that effective management necessitates independent governing bodies, free from partisan political influence, and composed of individuals with integrity and educational commitment. Advocate Md Nadir Khan and Advocate Md Sohel Rana represented the petitioner, while Deputy Attorney General Khan Ziaur Rahman appeared for the state.
