Prosecution Rejects Dismissal for Sergio Jadue, Cites Unexpired Charges

The Eastern Regional Prosecutor's Office has opposed a request to permanently dismiss charges against former National Professional Football Association (ANFP) president Sergio Jadue. The opposition was presented during a hearing at the Thirteenth Guarantee Court of Santiago.

Jadue, who has resided in the United States for over a decade, seeks to extinguish the criminal proceedings linked to alleged tax and money laundering offenses committed between 2015 and 2016. His defense claims the legal deadlines have passed, citing a pause in proceedings since extradition efforts began in 2017.

The reiteration of the crimes imputed to Mr. Jadue, in sum, are assigned by law a penalty of crime. And legislation establishes in our country that crimes prescribe the penal action in 10 years.

Prosecutor Marco Antonio Paredes argued that the crimes imputed to Jadue carry a penalty of "crime" under law, which has a 10-year statute of limitations. He stated that the period began on January 26, 2017, when Jadue was formally charged in absentia for extradition purposes. Furthermore, the prosecution highlighted that Jadue's continuous residence abroad doubles the prescription periods according to Chilean penal code regulations.

The Thirteenth Guarantee Court of Santiago will rule on the defense's motion on Tuesday, July 28, at 9:00 AM, determining whether to proceed with or dismiss Jadue's case.

As we consider that the last active resolution on our part was when we formalized in absentia to request extradition to the United States and it was granted by the Illustrious Court of Appeals of Santiago, that computation would begin to be counted on January 26, 2017.
