Provincial department recommends issuing land titles to Nha Trang residents after 30-year wait

The Department of Agriculture and Environment of Khanh Hoa province has reiterated its recommendation to the provincial People's Committee chairman to accept a complaint and issue land titles to residents in Ba Lang, Nha Trang. The case involves land purchased by Mr. Pham Van Tuan and Ms. Tran Quoc Thai Duyen over 30 years ago.

While the couple had previously received land use rights certificates for 150m2 of the 341m2 plot, their application for the remaining 173.5m2 was denied. Local authorities classified this portion as "illegally encroached land," a conclusion the Department of Agriculture and Environment has now deemed unfounded and inconsistent with prior state-confirmed legal documentation.

In a recent report, the department stated that the Nha Trang City Department of Agriculture and Environment's refusal to process the land title application was not based on valid grounds. They asserted that the land's legal origin had been previously confirmed by state agencies.

Therefore, the Khanh Hoa Department of Agriculture and Environment has proposed that the provincial People's Committee chairman issue a decision on the second complaint. This decision should accept the residents' complaint, revoke the Nha Trang City Department of Agriculture and Environment's notice of refusal, and overturn the previous decision by the chairman of the Nha Trang City People's Committee that rejected the initial complaint. The department also requested that the relevant authorities proceed with issuing the land use rights and property ownership certificates for the remaining 173.5m2 to Mr. Tuan and Ms. Duyen.
