Romanian High Court Overturns ROMATSA Certificate Suspension

The Romanian High Court of Cassation and Justice has definitively ruled in favor of ROMATSA and the Romanian Civil Aviation Authority (AACR), overturning a lower court's decision to suspend ROMATSA's air navigation services provider certificate. The supreme court admitted the appeals filed by ROMATSA and AACR, subsequently quashing parts of the Bucharest Court of Appeal's rulings.

In its re-examination of the case, the High Court accepted an exception of inadmissibility, thereby dismissing the action brought by the plaintiffs against ROMATSA, AACR, and the National Council for Combating Discrimination. The court also rejected requests to refer the case to the Court of Justice of the European Union.

The original decision by the Bucharest Court of Appeal in February 2026 had ordered the suspension of ROMATSA's certificate for one month, a move that had sparked significant controversy within the aviation sector. The High Court's final decision on August 26, 2026, brings this legal battle to a close, ensuring the continued operation of ROMATSA's services.
