Silk beverage class-action settlement approved with payments of $400-$300K

A significant class-action settlement, amounting to $7.5 billion, has been approved for Canadians who consumed certain recalled Silk and Great Value brand plant-based beverages. This settlement follows a deadly listeria outbreak in 2024 that was traced back to a line of refrigerated, plant-based drinks.

The outbreak, linked to products that may have included almond, oat, coconut, cashew, or mixed flavors, resulted in widespread illness. According to the Public Health Agency of Canada, there were 20 reported cases of listeriosis, leading to 15 hospitalizations and tragically, three deaths. Listeria is a bacterium that can contaminate food and water, causing illness when ingested.

Danone Canada, the company involved, has settled the lawsuit, though the settlement notice states the defendants "deny all allegations and deny any wrongdoing or liability." The settlement was approved in the Superior Court of Quebec in April. Consumers who purchased or ingested the recalled products, sold under the Silk and Great Value brands, have until October 16, 2026, to submit a claim.

Compensation levels vary based on the severity of harm experienced, ranging from $400 for less severe cases, which may require proof of purchase or a declaration of consumption and impact, up to $300,000 for more severe cases. Claimants in more serious situations may need to provide detailed medical and other records to support their claim. The settlement offers six tiers of compensation, with payouts determined by a compensation grid based on the documented physical and/or psychological harm suffered.
