South Korean Man Acquitted in Friend's Death Following Altercation

A 30-year-old man has been acquitted of charges of causing death by assault after a physical altercation with a childhood friend resulted in the friend's death. The Incheon District Court's 17th Criminal Division ruled that the prosecution failed to provide sufficient evidence to prove the defendant's actions directly led to the victim's demise.

The incident occurred on November 23, 2024, when the defendant, identified as Mr. A, engaged in a physical dispute with his friend, Mr. B, aged 32 at the time of his death. The prosecution alleged that Mr. A pushed Mr. B, causing him to become trapped between a bench and a fence, leading to death by cervical compression.

However, the court found the evidence, including dashcam footage from the scene, inconclusive. While the video showed the two individuals pushing and falling, the court stated that the specific process by which the victim's neck became trapped and the defendant's actions in pressing down on the victim to cause death were not clearly identifiable.

Given the lack of definitive proof linking the defendant's actions to the fatal outcome, the court determined that it could not be reasonably concluded that Mr. A assaulted Mr. B in a manner that caused his death. The acquittal highlights the high burden of proof required in criminal cases, even when a death occurs following a physical altercation between individuals known to each other.
