T.C. Ilgın 3rd Civil Court of First Instance Ruling

The Ilgın 3rd Civil Court of First Instance in Turkey has issued a ruling in a land expropriation case initiated by Türkiye Elektrik Dağıtım Anonim Şirketi (TEDAŞ). The lawsuit involved defendants Rahman GÜN and Hatice DOĞAN, whose addresses could not be determined, leading the court to order a public announcement of the ruling.

The court accepted TEDAŞ's claim, granting the company a permanent right-of-way on a 587.99 square meter section of a 5,450 square meter plot of land. This land, registered under parcel number 0 ada 1763 in Çavuşçu Mahallesi, Ilgın İlçesi, Konya Province, is designated for energy transmission line infrastructure.

The court determined the compensation for this permanent right-of-way to be 47,575.02 Turkish Lira. Interest, calculated at the highest rate applicable to public receivables, will be applied from the lawsuit's filing date of August 1, 2024, up to the decision date of March 4, 2026.

Funds deposited by TEDAŞ into a court-designated account at Türkiye Ziraat Bankası Ilgın Branch will be paid to the property owner, the defendant, in proportion to their share. The ruling also mandates that any existing encumbrances on the property, such as mortgages or liens, be reflected in the payment to the defendant. The court has ordered that a summary of the ruling be sent to the Ilgın Land Registry Directorate for registration. The decision is final regarding registration, but parties have two weeks from the announcement date to appeal the monetary aspect to the Konya Regional Court of Justice.
