Taiwanese Firm Owner Jailed for Illegal Wastewater Discharge, Illicit Gains Exceed $140 Million

Hongding Development Engineering Company in Taiwan illegally discharged wastewater containing heavy metals into nearby fields. The company's owner, identified by his surname Chen, and nine employees were indicted by the Taoyuan District Prosecutors Office. Investigations revealed that the company had been operating an illegal factory, storing waste in sludge ponds and then discharging the contaminated wastewater through privately installed pipelines into adjacent farmland.

Authorities confirmed that the factory began discharging the hazardous waste, which exceeded water pollution control standards, in November 2021. The illegal operation was discovered and investigated by a joint team of police, prosecutors, and environmental protection personnel. The estimated illicit gains from this operation surpassed NT$4.5 billion (approximately US$140 million).

Prosecutors calculated that over NT$4.3 billion represented "passive gains" from avoided disposal costs, while "active gains" from receiving soil, waste soil, or sludge exceeded NT$170 million. The Taoyuan District Court sentenced Chen to 5 years and 2 months in prison and imposed a fine of NT$3 million. The judge noted Chen's pursuit of illegal profits, disregarding the potential environmental damage to farmland and water resources.

In addition to Chen's sentence, other defendants received prison terms ranging from 1 year to 3 years and 10 months. Hongding Development and a cooperating transportation company were jointly fined NT$3 million. The court emphasized that Chen's actions harmed the environmental legal order and public interest.
