US judge blocks Pentagon from listing WuXi as Chinese military-linked firm

A federal judge has halted the U.S. Defense Department's effort to designate Chinese biotechnology company WuXi AppTec as a firm linked to Beijing's military. U.S. District Judge James Boasberg issued an order on Friday preventing the Pentagon from enforcing the designation, citing a lack of evidence to justify the decision.

WuXi AppTec had filed a lawsuit challenging the designation, which was initially planned for June. The company argued that the label was arbitrary, capricious, unsupported by facts, and a product of political pressure. Since the designation, WuXi has experienced significant repercussions, including canceled contracts and terminated business relationships from customers and suppliers who have shifted their business to competitors.

Judge Boasberg acknowledged the severe impact of such a designation, stating, "A scarlet letter sends a clear message: keep away." The Pentagon has declined to comment on the ruling.

WuXi AppTec welcomed the court's decision, expressing relief from the immediate negative consequences during the litigation process. A spokesperson for the company stated, "We believe that the facts, as demonstrated in our court filings, will prevail after an objective and fair judicial review."

The company highlighted its substantial presence in the U.S., employing approximately 450 people and serving over 1,000 customers. It also noted that a majority of its board and executive managers are U.S. citizens, and U.S. customers accounted for about 70% of its revenue last year. WuXi, founded in 2000, provides research, development, and manufacturing services to over 4,000 pharmaceutical and life sciences companies globally, with a market value around $43 billion.

The Pentagon's move was part of a broader effort to expand its blacklist of Chinese companies deemed to support Beijing's military advancements, amid heightened geopolitical tensions. Under recent U.S. law, companies on this list face restrictions on government contracts starting later this month and limitations on product and service purchases from 2027. Inclusion on the list does not equate to formal sanctions.
