USCIS activates rule for mandatory online immigration applications

The U.S. Citizenship and Immigration Services (USCIS) has implemented a new rule that grants it the authority to require online submission for specific immigration benefit applications. This rule, effective August 11, signifies a move towards modernizing the agency's processes, though it does not immediately eliminate paper forms.

USCIS must first identify which applications will be subject to mandatory electronic filing and announce these changes at least 60 days in advance. The final provisional rule, published in the Federal Register, states that electronic submission will only become obligatory after a form has been available online for at least 180 days. This phased approach ensures applicants have ample time to adapt.

The agency anticipates substantial cost savings through this transition. For fiscal years 2027 to 2036, the Department of Homeland Security estimates annual savings of $533 million for applicants, with a net estimated saving of $518 million per year after accounting for new costs. An additional $140 million is expected to be transferred annually through discounts for digital submissions.

This shift aims to reduce the handling of paper documentation, expedite the electronic transition, and enhance data analysis to combat fraud and bolster security. USCIS will require applicants to create a myUSCIS account for electronic submissions, which will feature guided digital forms or the option to upload PDF files along with supporting evidence. The system is designed to automatically check for mandatory fields and alert users to any rejections.
