Vietnam Proposes 'Strong Political Mettle' Standard for Lawyers in Draft Law Revision

Vietnam's Ministry of Justice is seeking public feedback on a revised draft of the Lawyer Law, which includes a significant new requirement for legal practitioners: "strong political mettle." This proposed standard aims to ensure lawyers possess a firm understanding of the country's political system and are committed to defending national interests and justice.

The draft legislation specifies that lawyers must have a correct perception of the political system, a commitment to justice, and a dedication to protecting national and ethnic interests. It explicitly states that lawyers should not exploit their profession to undermine national security or social order. This standard is intended to be applied throughout a lawyer's career, from training and apprenticeship to the issuance of practice certificates.

Furthermore, the draft law proposes streamlining the procedures for becoming a lawyer. Apprentices will join lawyer associations from the outset as trainees, receiving guidance throughout their apprenticeship period, a change from the current system where they join only after receiving their certificate. The rights and obligations of trainees will also be adjusted to enhance practical experience opportunities.
