Active Air Force Major Defeats Múcio and Valdemar, Registers Candidacy for Federal Deputy

A major in the Brazilian Air Force (FAB) has overcome an attempt by high-profile political figures to block his candidacy for federal deputy. Emmanuel Novaes, who is still active in the FAB, successfully registered his bid with the Liberal Party (PL) in Roraima after the Electoral Justice ruled in his favor.

The effort to prevent Novaes' candidacy was led by Defense Minister José Múcio Monteiro and PL party president Valdemar Costa Neto. According to reports, Múcio requested Costa Neto to withdraw Novaes' party affiliation due to the major's history of political activism and inflammatory remarks on social media targeting leftists and even his superiors.

Costa Neto initially agreed to Múcio's request, stating his trust in the minister. However, the state executive of the PL, following national party directives, submitted a request to the Regional Electoral Court of Roraima (TRE-RR) to exclude Novaes' registration. The court ultimately denied this request, deeming it too late as it was filed after the party convention and the official registration deadline.

The party, through its statutes and delegated acts, can do a lot, but it cannot do everything. That is, party autonomy finds insurmountable limits in constitutional guidelines, so that intervention acts cannot occur abruptly, authoritatively, and without adversarial process, violating the subjective right that was perfected with the choice in convention and the consequent start of the official electoral campaign.

In her ruling, Judge Joana Sarmento de Matos emphasized that while party autonomy is significant, it has constitutional limits. She stated that abrupt interventions violating a candidate's rights, solidified by convention approval and the start of the official campaign, cannot occur. Novaes, who has previously run unsuccessfully for state deputy and has a history of anti-leftist rhetoric, celebrated the decision on social media, framing it as the beginning of a 'war.'
