Bali DPRD Accepts Provincial Government Input on Draft Local Legal Product Regulation

The Bali Regional People's Representative Council (DPRD) has officially accepted all feedback from the Provincial Government regarding the draft regional regulation on the Procedures for the Formation of Local Legal Products. This acceptance occurred during the discussion phase of the council's initiative in Denpasar.

I Nyoman Wirya, the coordinator for the draft regulation's discussion, stressed that all input from the governor is crucial for the joint deliberation. The goal is to produce local legal products that are of high quality, implementable, and adaptive to national legal developments, while also embodying Bali's local values and wisdom.

All input from the governor will be an important part of the joint discussion process so that this draft regulation can produce quality legal products that are implementable, adaptive to national legal developments, and still reflect the local values of Bali.

Both the DPRD and the Governor of Bali concur that the drafting of regional regulations must adhere strictly to principles of legal certainty, proper procedure, and existing laws. Wirya confirmed that the drafting techniques, systematization, codification, terminology, norm formulation, and overall format will align with Law Number 12 of 2011 concerning the Formation of Laws and Regulations, as amended, and the Minister of Home Affairs Regulation Number 80 of 2015.

Furthermore, the DPRD fully accepted the governor's input on the mechanism and timeline for facilitating the draft regulation with the Minister of Home Affairs. The council believes the most appropriate time for this facilitation is after the first reading and before the final decision during the second reading. This process ensures harmonization, synchronization, and refinement of the draft's content, preventing conflicts with public interest and higher-ranking regulations, ultimately leading to a better quality regulation with legal certainty.

We are of the view that the facilitation process after the completion of the First Reading and before the decision-making in the Second Reading is the appropriate mechanism, both from a legal and substantive aspect, as regulated in Article 88 of the Minister of Home Affairs Regulation Number 80 of 2015.
