Brazil's Bar Association asks court to allow lawyer-son to see jailed ex-president

Brazil's powerful Bar Association (OAB) has formally requested that Supreme Court Justice Alexandre de Moraes reinstate Senator Flávio Bolsonaro's ability to communicate with his father, former President Jair Bolsonaro, who is currently under house arrest. The OAB's intervention comes after Justice Moraes issued a 90-day ban on Flávio visiting his father, deeming that the senator had violated a court order.

Justice Moraes's decision stemmed from Flávio Bolsonaro's actions over the weekend. The senator read a letter from Jair Bolsonaro during a social media broadcast and shared a photograph of his visit. Moraes interpreted these actions as a violation of the existing order that prohibits the former president from using social media, directly or indirectly. The justice also suggested that Flávio's conduct constituted an instrument for political promotion and referred the matter to the electoral prosecutor's office to investigate potential early election campaigning.

Flávio Bolsonaro, who is also a lawyer, is part of his father's defense team. He approached the OAB's National Directorate for the Defense of Prerogatives to secure his right to maintain contact with Jair Bolsonaro. In an official letter to Justice Moraes, the OAB is asking for the assurance of "personal and confidential communication between the lawyer and their client for strictly professional purposes," within the parameters set by the minister. The association stressed that its involvement is purely institutional and aims to uphold the prerogatives of the legal profession without interfering with the merits of the penal execution or the court's decisions.

Flávio Bolsonaro had previously stated that the OAB would intervene, asserting that lawyers' access to their clients is a non-negotiable prerogative. The ability to visit his father is significant for the senator, as it allows him to coordinate strategies related to his own presidential pre-candidacy with the former president.
