California approves law AB 2781, modifying judicial fees starting July 2026

California is set to implement significant changes to its judicial fee structure with the approval of law AB 2781 by Governor Gavin Newsom. The legislation, which takes effect in July 2026, aims to update the fee system for various civil proceedings across the state.

A key aspect of AB 2781 focuses on small claims cases. Previously, the $50 filing fee applied only to claims between $1,500 and $5,000. Under the new law, this fee will now cover claims up to $6,250. For individuals who have filed 12 or fewer small claims in the past year, the filing fee remains $50 for claims up to this new limit. However, those filing more than 12 claims within a 12-month period will continue to pay $100 per case, provided they submit a declaration confirming they do not exceed the limit.

The law also revises the process for increasing the amount of a claim after initial filing. If a case initially filed with a lower fee later has its claim amount increased to fall into a higher fee category, the plaintiff will only need to pay the difference between the two fee tiers. This adjustment is designed to streamline the process for litigants seeking to amend their claims.

AB 2781 establishes a three-tier payment structure based on the value of the claim. For claims of $12,500 or less (excluding attorney fees and court costs), the uniform fee remains $205. If the claim exceeds this threshold, the fee increases to $330. The law specifies that these additional payments must be made at the time of filing the modification, and no refunds will be issued if the claim amount is later reduced.
