Member of Parliament and jurist Cabral Libii asserts that under current law, specifically the April 14, 2026 revision of Article 38 of the law organizing the Constitutional Council, only the vice president is empowered to refer the matter to the council for a declaration of definitive impediment of the head of state. Libii emphasizes that this revision did not preserve previous provisions granting such authority elsewhere.

However, lawyer Bomo Ntimbane presents a counterargument, citing legal principles that he believes grant the president of the National Assembly the competence to initiate the process of declaring a presidential vacancy.
