Caregiver receives suspended sentence for causing patient's death

A caregiver of Chinese nationality has received a suspended prison sentence for fatally pushing a wheelchair-bound patient. The incident occurred in July last year at a nursing hospital in Hanam, Gyeonggi Province.

The caregiver, identified as A, pushed the patient's wheelchair with their foot as the patient attempted to board an elevator. The patient fell, suffering a concussion that led to their death. Investigators found that A acted out of annoyance, believing it would be troublesome if the patient entered the elevator.

In the appeal, the prosecution argued that the initial sentence was too lenient. However, the Suwon High Court upheld the original sentence of two years in prison, suspended for three years. The court stated that the sentencing conditions had not changed significantly and that the original sentence fell within a reasonable range of discretion.

The court acknowledged the irreversible and severe consequences of A's actions and the profound emotional distress inflicted upon the victim's family. However, mitigating factors considered included A's admission of guilt, no prior criminal record in South Korea, the belief that the act stemmed from a momentary lapse in judgment rather than intent to harm, and a settlement reached with the victim's family.
