Constitutional Court Rules on Sierra Bella Case, Reinstates Collection Lawsuit

The Constitutional Court has concluded a six-month suspension of an executive collection trial concerning Sierra Bella, initiated by Inmobiliaria San Valentino. The court's decision not only ended the judicial pause but also addressed a key legal question.

Despite the constitutional conflict being resolved by the withdrawal of challenges against witnesses, the court proceeded to a substantive analysis. It established a relevant precedent: the debate over whether municipal officials and council members can be classified as "dependents" for the purpose of witness disqualification is a matter of legality. This issue, the court ruled, falls under the purview of civil judges, not constitutional justice.
