Court Temporarily Bars VAATC from Claiming Guarantees in Vilnius Waste Plant Contract Dispute

The Vilnius Regional Court has issued temporary protective measures, prohibiting VAATC (Vilniaus atliekų gamyklos eksploatavimo ir modernizavimo sutartis) from claiming guarantee payments from "Energesman" and "BTA Baltic Insurance Company." This decision, made at the request of "Energesman," halts the insurance company from paying out contract security guarantees until a final court ruling is reached in two separate cases concerning the legality of terminating contracts for the Vilnius waste incineration plant.

"Energesman" had already approached "BTA Baltic Insurance Company" to claim these payments. However, the court's temporary measures indicate that the contract termination issue is far from resolved. Algirdas Blazgis, director of "Energesman," stated that these measures demonstrate the ongoing dispute over the contract terminations.

VAATC, while acknowledging the court's procedural decision, noted that the court partially rejected "Energesman's" request by refusing to suspend the validity of the guarantee insurance letter itself. According to VAATC, the temporary measures are specifically related to a contract signed in May for the installation of a municipal solid waste sorting line. VAATC stated they were not expecting insurance payouts at this stage, given the ongoing legal dispute, and would have acted responsibly themselves. They emphasized that the court's decision should not be interpreted as a final resolution of the main dispute or an endorsement of any party's position.
