Danna Yanina's defense seeks judge's removal over due process violations

The defense for Danna Yanina has formally requested the recusal of Judge María Ciria Mora González, alleging that the judge has repeatedly violated due process in the ongoing case.

"What does it mean that she excuses herself? It means that, as a judge, you have repeatedly violated Danna's due process and rights, so you should no longer handle the matter," stated lawyer Carlos David Robles Figueroa in an interview. He added that Danna's parents and the accused have already initiated proceedings against the judge.

Robles Figueroa outlined that the defense is pursuing several parallel legal avenues to secure Danna's freedom, including the main legal process, an appeal, and an amparo lawsuit. Danna was arrested on July 22 and subsequently charged with the femicide of Dafne Zapata Quintos at the Doenitz Military Academy in Ciudad Madero.

Protesters chanted "Justice, justice, justice!" and "The judge is corrupt!" outside the CIJ facilities. Robles explained that if the judge does not recuse herself, the defense has filed a challenge, which requires the proceedings to be suspended and the case to be reassigned to a new judge by higher authorities.

The defense has filed three complaints against the judge. Robles noted that the judge has consistently shown partiality, favoring the Public Ministry. He expressed doubt that the judge would grant a release request, given her alleged ongoing violations of Danna's rights and refusal to schedule hearings. The defense is also pursuing an appeal, with a hearing scheduled for September 8.
