Electoral Justice grants preliminary injunction, allowing Marçal to file presidential candidacy

The Electoral Justice in São Paulo has granted a preliminary injunction that permits influencer Pablo Marçal to affiliate with the PRTB party, potentially paving the way for his presidential candidacy. This provisional measure, issued by electoral judge Gustavo Nardi, allows Marçal to file his registration request.

However, Marçal's path to the presidency remains obstructed by an existing ineligibility ruling. In August, the Regional Electoral Court of São Paulo (TRE-SP) upheld his eight-year ban from holding office, stemming from the misuse of communication channels during the 2024 São Paulo mayoral campaign. He was found guilty of promoting videos with the hashtag #prefeitomarçal in exchange for prizes, a practice prohibited by electoral law.

Marçal's defense team is actively seeking to overturn this ineligibility. They have filed appeals, including embargos de declaração, against the court's decision. While two accusations, abuse of economic power and illicit campaign fundraising, were dismissed due to insufficient proof of direct payments, the conviction for improper use of social media stands.

The conviction centers on a strategy involving the mass dissemination of video clips from the "Cortes do Marçal" community on Discord. Participants were incentivized to share these clips using the #prefeitomarçal hashtag, with the promise of prizes, a tactic deemed illegal by electoral legislation. Marçal's defense aims to present their case to the Superior Electoral Court (TSE) in hopes of reversing the ruling.
