France's Constitutional Council Approves Assisted Dying Bill Under Strict Conditions

France's highest constitutional authority, the Constitutional Council, has declared the country's assisted dying bill fully constitutional. This landmark decision allows adults suffering from incurable diseases and unbearable pain to access assisted dying, provided they meet stringent criteria. The bill, which passed through parliament in mid-July after years of public debate, positions France alongside countries such as the Netherlands, Belgium, Switzerland, and Canada that have already legalized similar measures.

President Emmanuel Macron hailed the council's ruling as the "end of a democratic debate that was exemplary." The legislation stipulates that applicants must be adults, either French citizens or long-term residents, experiencing unbearable suffering due to conditions unresponsive to treatment or when they refuse or cease treatment. A physician must first confirm eligibility, followed by an assessment from a specialized panel to ensure all conditions are met.

Following medical approval, patients must wait at least two days before the assisted dying procedure can commence. Their consent must be reconfirmed on the day of the procedure, and they retain the right to withdraw their consent at any time. While the patient is expected to self-administer the lethal medication, medical professionals can assist if the patient is physically unable to do so.

Despite approving the bill, the Constitutional Council identified three points within the legislation that require further clarification. These include the "conscience clause," which allows healthcare professionals like nurses and pharmacists to refuse participation in assisted dying procedures.
