French Court Overturns Burkini Ban on Cote d'Azur Beach

A French administrative court in Nice has annulled a ban on wearing the "burkini" swimsuit on a beach in the resort town of Mandelieu-la-Napoule. The court declared the measure a serious and illegal violation of fundamental freedoms, including freedom of movement, conscience, and personal liberty.

The ban on wearing swimwear that covers the entire body, which is worn by many Muslim women, constitutes a gross and illegal violation of freedom of movement, freedom of conscience, and personal liberty.

The municipality had justified the ban by stating that the full-body swimwear, worn by many Muslim women, could pose a threat to public order. However, the court found that the municipality failed to provide any evidence to support this claim. It noted that the decision was based on only two incidents from over a decade ago, which it deemed insufficient to warrant such a prohibition.

The judges emphasized that there was no data proving the burkini poses a risk to the safety of beachgoers or swimmers, rendering the ban legally baseless. This ruling reignites the ongoing debate in France surrounding religious attire in public spaces, a discussion that resurfaces each summer as some municipalities reimpose restrictions on the burkini.

The municipality did not provide any evidence to support this claim, noting that it was based only on two incidents from 10 and 14 years ago, which it considered insufficient to justify imposing this ban.

Despite previous annulments of similar bans by the Council of State, France's highest administrative court, some coastal towns continue to issue temporary summer bans. Mandelieu-la-Napoule was the first French seaside resort to ban the burkini in 2012, and its conservative mayor has repeatedly renewed the decision despite court rulings against its legality.
