Government proposes reducing the deadline for accepting inheritance from ten to two years

The Portuguese government has put forward significant proposals to reform the country's succession laws, aiming to streamline the process of inheritance acceptance and estate management. A key change involves reducing the window for heirs to formally accept an inheritance from the current ten years down to just two. This move is intended to expedite the distribution of assets and reduce legal uncertainties.

Furthermore, the proposed legislation introduces a notable shift in the hierarchy of estate management. Under the new rules, a "testamenteiro"—an individual appointed by the deceased to oversee the distribution of their assets—could be granted precedence over the surviving spouse in assuming the role of head of the inheritance. This provision, however, is contingent on the deceased explicitly stating this preference beforehand, offering a degree of testamentary control.

These proposed amendments reflect a governmental effort to modernize inheritance procedures and provide clearer guidelines for executors and beneficiaries. The proposals are now set to be debated and voted upon by the Portuguese Parliament.
