Hong Kong taxi driver jailed 8 weeks for overcharging, fleeing undercover officer

A Hong Kong taxi driver has been sentenced to eight weeks imprisonment and ordered to pay a HK$3,000 fine after being convicted of overcharging an undercover police officer and then attempting to evade authorities by speeding away.

Chan Wai-kee, 64, pleaded guilty at the Eastern Magistrates’ Courts to one count of careless driving and two charges of overcharging. The offenses occurred on April 29 when an undercover officer, posing as a passenger, was quoted a flat fare of HK$280 for a journey to Tsim Sha Tsui – a price estimated to be HK$150 above the standard rate. Chan proceeded to drive the passenger without activating the taximeter.

After reaching the destination and receiving cash payment, Chan accelerated rapidly and sped away when a plainclothes officer identified himself as law enforcement. This dangerous maneuver endangered the officers and nearby pedestrians. Chan surrendered to the police the following day.

The court heard that Chan has a history of 32 prior criminal convictions, including offenses related to overcharging. He also has seven previous traffic convictions, two of which were for careless driving. Despite his record, his defense argued for leniency, citing his voluntary surrender as a sign of remorse and suggesting he was unlikely to reoffend.

Principal Magistrate David Cheung deemed imprisonment necessary due to the risks Chan created by attempting to flee. Under Hong Kong law, the maximum penalties for overcharging and careless driving are six months imprisonment and substantial fines.
