Khanh Hoa Province Demands Phuc Son Group Legal Documents for Old Nha Trang Airport Projects Amidst Legal Scrutiny

Khanh Hoa province has formally requested that Phuc Son Group submit all legal documentation and details concerning the implementation of its projects at the former Nha Trang airport. This directive stems from a need to review and address issues associated with these developments, following recommendations from the Central Military Court.

The provincial People's Committee specifically requires Phuc Son Group to provide comprehensive legal records. These include investment policy decisions, land allocation and lease approvals, construction permits, Build-Transfer (BT) contracts, and all related official documents. The company must also submit records defining project boundaries, scope, and area, along with current maps, VN-2000 coordinates, and documentation of completed construction phases, including acceptance and completion reports.

Furthermore, Phuc Son Group is tasked with reporting on the entire project lifecycle since its inception, detailing completed work, identifying challenges, and proposing solutions. A significant aspect of this review involves addressing the rights of individuals and entities who have entered into contracts with Phuc Son Group for projects at the old airport site. The company is expected to propose a clear plan for resolving these issues, aiming for a harmonious balance between the company's interests and those of the affected parties, as advised by the Central Military Court.

This directive comes in the wake of a court ruling where Nguyen Van Hau, former Chairman of Phuc Son Group, was sentenced to 11 years imprisonment for his involvement in the Nha Trang airport project. This sentence, combined with others, brings his total prison term to 30 years. The court also ordered Hau to compensate investors over 7 trillion Vietnamese dong (approximately $280 million USD), after he knowingly proceeded with project policies and signed 983 contracts with 683 parties, collecting over 7 trillion dong despite the project lacking legal certainty.
