Marcin Szwed: “I see no hope of restoring the Constitutional Tribunal”

Marcin Szwed of the Helsinki Foundation for Human Rights says he sees no hope of restoring Poland’s Constitutional Tribunal in its current condition.

He argues that the tribunal cannot effectively perform its role if people with links to one political authority or another sit on it. Otherwise, he said, the body becomes merely an instrument of political struggle, which he believes is happening now.

If the Constitutional Tribunal is to effectively perform its function, it is obvious that people with ties to this or that authority cannot sit on it. Otherwise, the Constitutional Tribunal would be merely an instrument of political struggle, which is what we are dealing with today.
